Famous Five

The Persons Case

 

After many attempts to have a woman appointed to the Canadian Senate and being refused because woman were not persons in federal law. The 'Famous Five'

Canadian woman, Emily Murphy, Nellie Mooney McClung, Irene Marryat Parlby, Louise Crummy McKinney and Henrietta Muir Edwards asked the Supreme

Court of Canada to answer the question "Are women persons?After five weeks of debate and argument the Supreme Court of Canada decided that the word

"person" did not include women.

 

The five woman refused to accept the decision and took the Persons Case to the Privy Council in England which in those days, was Canada's highest

court. The women of Canada rejoiced when the Privy Council finally announced, on 18 October 1929, that Canadian women were indeed persons.
